Terms of Service
Inclusive, Affordable, and AI-Powered Mental Wellbeing Support for Every Child
These Terms of Service ("Terms") govern your access to and use of the Xpolarity platform and related services (collectively, the "Platform") operated by XPOLARITY TECHNOLOGIES PRIVATE LIMITED ("Xpolarity", "we", "us", or "our"). By accessing or using the Platform, you agree to these Terms.
1. About Xpolarity
Xpolarity is a digital wellbeing platform developed and operated in India. It is designed for children and young persons between the ages of 3 and 18 years, and serves schools, parents, mental health counsellors, psychologists, and special educators.
The Platform brings together assessment and support tools under one system to help schools build mental health infrastructure — from early screening and wellbeing monitoring to coordinated care and crisis response.
2. Our Services
The Platform broadly covers the following areas:
- Screening and Assessment — Tools to identify developmental, learning, behavioural, neurodevelopmental, and mental health needs at an early stage.
- Wellbeing Monitoring — Ongoing tracking of a child's emotional, social, psychological, and physical wellbeing.
- Career Guidance — Assessments and AI-assisted tools, including the Career Suitability Index (XCSI), to help students understand strengths, interests, and age-appropriate career options.
- Crisis and Safety Response — Brave Bee (anonymous reporting system) and a structured escalation process for concerns involving bullying, abuse, distress, or risk of harm.
- Mental Health Support — Access to the Dhruva Support Line (24×7 tele-mental health helpline) and the Child Support Hub (nodal centre and professional referral network).
- Learning and Development — Individual Education Plans (IEP), Personalised Learning Profile (Learning DNA), and social-emotional learning support for children with diverse learning needs.
- AI-Assisted Tools — Wise Turtle (AI Wellbeing Companion) and the AI Career Counsellor, providing age-appropriate guidance, psychoeducation, and self-help support.
These services are supportive and informational in nature. They do not constitute clinical diagnosis, medical treatment, or emergency response.
3. Who May Use the Platform
The Platform is currently available to users residing in India. If you or your child are residing outside India, you are not currently eligible to use the Platform.
Users under 18: Access to the Platform by a child under 18 years requires verified consent from a parent or legal guardian, in accordance with applicable Indian law, including the Digital Personal Data Protection Act, 2023 ("DPDP Act"). A separate parental consent process applies in addition to these Terms. See our Privacy Policy for how we handle children's data.
School staff, counsellors, and other professionals may access the Platform only through accounts authorised by their school or institution.
4. Your Responsibilities
When using the Platform, you agree to:
- Provide accurate and up-to-date account information.
- Use the Platform only for lawful purposes and in accordance with these Terms.
- Keep your login credentials secure and not share them with unauthorised persons.
- Cooperate with your school or institution where access is school-facilitated.
- Not misuse, harass, or attempt to harm other users or the Platform.
- Not attempt to re-identify anonymised data or circumvent security measures.
5. Nature of the Service — Important Limitations
Please read this section carefully before using the Platform.
Not a medical device or clinical service
The Platform is not a medical device and has not been registered or approved as a medical device under the Medical Devices Rules 2017 (India) or any equivalent regulation. It does not provide clinical diagnosis, psychiatric treatment, psychological therapy, or emergency mental health intervention. No feature or output of the Platform establishes a clinical relationship between Xpolarity and any user.
Assessments are indicators only
All assessments, screening checklists, and measurement tools on the Platform are indicators only. They identify areas that may warrant further attention or professional review. They do not constitute a clinical diagnosis, psychological evaluation, medical opinion, or legal determination of any condition or disability. No educational placement, treatment, clinical, or safeguarding decision should be made solely on the basis of Platform results. A qualified professional must review all results before any action is taken.
AI tools are supportive, not clinical
Wise Turtle, the AI Career Counsellor, and all other AI-powered features provide general wellbeing information and supportive guidance only. They are not mental health professionals, licensed counsellors, psychologists, or psychiatrists. AI responses are generated by pattern-recognition algorithms and may occasionally be inaccurate, incomplete, or inappropriate for individual circumstances. AI tools must not be used as a substitute for clinical assessment, diagnosis, therapy, or crisis intervention.
Crisis detection is assistive
The Platform's AI risk detection system is a supportive tool and not a substitute for human judgement. No automated system can guarantee identification of every risk situation. Every AI-generated risk flag proceeds to human review by a trained Human Safety Proctor before any action is taken. No safeguarding decision is made solely by the AI system.
Not an emergency service
The Xpolarity Platform — including Wise Turtle, Brave Bee, and the Dhruva Support Line — is not an emergency service. These services are not continuously monitored in real time for every user at all times. Response times cannot be guaranteed.
In any situation involving immediate risk to life, contact emergency services directly:

Brave Bee anonymity
Anonymous reporting through Brave Bee does not guarantee confidentiality in all circumstances. If a report discloses an immediate risk to life or serious physical harm, Xpolarity or the partner school may be legally required to share identifying information with emergency services, law enforcement, or child protection authorities.
Career and IEP guidance
Career assessment results and IEP recommendations are planning and guidance tools only. They do not predict academic achievement, professional success, or employment outcomes. Career results must not be used to restrict, limit, or determine a child's access to educational programmes, academic streams, or opportunities of any kind.
6. Acceptable Use
You must not use the Platform to:
- Violate any applicable law or regulation.
- Harass, abuse, or harm another person.
- Upload false, misleading, or harmful content.

You receive a limited, non-exclusive, non-transferable right to use the Platform for its intended purposes while your account is active and in good standing. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our prior written consent.
8. Changes and Availability
We may update the Platform's features, services, and these Terms from time to time. Material changes will be reflected on this page with an updated effective date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
We do not guarantee uninterrupted or error-free availability of the Platform. Scheduled maintenance or unforeseen outages may occur.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Xpolarity and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
Xpolarity expressly disclaims liability for any decision made solely on the basis of screening or assessment results without professional review. We do not represent, guarantee, or warrant that every risk event will be detected by the Platform's automated systems.
Nothing in these Terms limits liability that cannot be excluded under applicable Indian law.
10. Governing Law
These Terms are governed by the laws of India, including the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025, the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Indian Contract Act, 1872, as applicable.
